What does GDPR mean?

The EU General Data Protection Regulation (EU Regulation 2016/679), short form EU-GDPR, is the most important and biggest change to data protection in the past 20 years. The GDPR applies to all companies that process, store or transfer personal data of EU citizens. For the first time, the new law provides a single and common legal basis for data protection in Europe.

With the GDPR, the EU simplifies and harmonises data protection laws across Europe and aims to give EU citizens greater control over their personal data.

Important facts about the GDPR at a glance:

  • The GDPR will apply from May 2018 to all companies operating in the European market, regardless of their company domicile, as long as they process data fomr EU citizens.

  • Secure FTP servers are not always GDPR compliant because it must be ensured that all external processes use secure protocols such as SFTP, FTPS or HTTPS and encryption. Setting up secure processes can be a huge expense for the admin.

  • Regulatory authorities can impose fines of up to € 20 million, or 4% of global annual turnover. This will significantly increase the fine.
  • Privacy by Default & Privacy by Design become a must-have for businesses of all kinds. Any form of data processing must meet the preconceptional integration of data protection requirements and preconfigure them by default.

  • When handling personal data, a "state of the art" protection is required. In many transmission paths, this is often not the case.

  • In the future, all data protection breakdowns must be reported, no matter what type of data was lost. This notification must be submitted to the regulatory authority within 72 hours of becoming aware. Affected parties must also be notified.
